9. Conclusion and termination of the sales contract, complaints:

These Terms, together with the specific terms of sale stated with individual products, constitute an offer by Biofarm d.o.o. to conclude a contract. By placing an order, or in another way set out in these Terms, the user as a customer accepts them, and a contract between the user and Biofarm d.o.o. is deemed concluded under the terms of sale set out in these Terms.

The subject and commercial purpose of the contract is the purchase of the selected product or service through the Biofarm web shop against payment of the corresponding price. The contract is concluded by means of distance communication (distance contract), namely through printed promotional messages with an order form and the Internet.

The contract enters into force and becomes binding when the order is placed and the invoice is issued.

The user may withdraw from the contract within 14 (fourteen) days without giving any reason.

To exercise the right of withdrawal, the user must inform Biofarm d.o.o. of the decision to withdraw before the deadline expires, by an unequivocal statement sent by post (to Biofarm d.o.o., Ventilatorska 14, 10250 Zagreb, Lučko) or by e-mail to info@biofarm.hr , stating your name and surname, address, telephone or fax number or e-mail address. The user may also use the written withdrawal form.

The user may also fill in the withdrawal form electronically and send it (download the form here, in Croatian). In that case, Biofarm d.o.o. will send confirmation of receipt of the withdrawal notice by e-mail without delay.

The withdrawal period is 14 (fourteen) days from the day on which the goods were handed over to the user or to a third party designated by the user, other than the carrier, or, in the case of a service, from the conclusion of the contract.

If the user withdraws from the contract, all payments received from the user, including delivery costs, will be refunded without delay and no later than 14 (fourteen) days from the day on which Biofarm d.o.o. or the Biofarm web shop receives the user’s withdrawal decision, unless the user chose a type of delivery other than the cheapest standard delivery offered. The refund will be made using the same means of payment the user used. If the user agrees to another method of refund, the user will not bear any costs of the refund. Biofarm d.o.o. may withhold the refund until the goods have been returned or until proof has been provided that the goods have been sent back.

The user must hand over or send the goods to Biofarm d.o.o., Ventilatorska 14, 10250 Zagreb, Lučko, without undue delay and in any case no later than 14 (fourteen) days from the day on which the user sent the withdrawal decision to Biofarm d.o.o. or the Biofarm web shop. The user bears the direct costs of returning the goods.

The user is liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods. If the original packaging is damaged, the refund will be reduced by a percentage corresponding to the value of the goods. In that case, you will be informed.

Liability for material defects is governed by the Civil Obligations Act, and the seller’s liability for material defects lasts at least two years from the delivery of the product.

In accordance with Article 10 of the Consumer Protection Act (Official Gazette Nos. 19/22, 59/23 and 59/26), we inform consumers that they can express dissatisfaction with the service provided by a written complaint to the address:

The Company always takes care to collect only the personal data necessary to achieve the lawful purpose for which the data is processed.

Purposes for which personal data is collected and further processed

The Company collects personal data in order to provide, maintain, protect and improve its services related to the purchase of products, to understand how users and/or customers use the services and the Company’s website, and to fulfil the Company’s contractual obligations. The Company collects such data on the basis of consent given by the user and/or customer for one or more specific purposes, or in one of the following cases.

Performance of contractual obligations

The Company collects and further processes personal data of users and/or customers to conclude and perform contracts, deliver ordered products, provide advice and assistance in using products, provide additional and/or extended product warranties, handle complaints of users and/or customers, and carry out other actions related to concluding and performing contracts in accordance with applicable regulations.
The legal basis for processing personal data of users and/or customers for these purposes is the necessity of concluding a contract. If the user and/or customer withholds essential data, the Company will not be able to conclude the contract and/or take certain actions related to its performance.

Compliance with legal obligations

Upon a written request by users and/or customers to the above address of the data protection officer, the Company is obliged to give them access to the personal data it processes about them, to rectify inaccurate personal data, to erase personal data or restrict its processing, and to inform them of the possibility to object to the processing of personal data and of the right to data portability. In addition, the Company is obliged to keep invoices and other accounting records containing customers’ personal data for the periods prescribed by law (at least 11 years under the Accounting Act).

Direct marketing

We send promotional e-mails (newsletter) only to users and/or customers who have agreed to receive them. The legal basis is consent, as described in the section “Newsletter and ads on social networks”.
We may send customers who have bought a product from us information about our similar products to the e-mail address obtained at purchase, unless they have objected. We offer the option to refuse when collecting the address and in every such message. The legal basis is the Company’s legitimate interest.
To make these messages match the wishes and habits of the user and/or customer, the Company personalises them using data on purchases and on opens and clicks in e-mails. The legal basis is the Company’s legitimate interest, and the user and/or customer may object to such processing at any time.
We do not make promotional phone calls or send promotional SMS messages without prior consent.

Internal purposes

The Company uses certain data of users and/or customers solely for its own records, to protect the legitimate interests of users and/or customers and/or the Company. For example, this includes using personal data to create offers that meet the needs and wishes of users and/or customers, and for market research and analysis.

Newsletter and ads on social networks

Newsletter

If you subscribe to the newsletter, we use your e-mail address to send you offers, news and advice. The legal basis is your consent. We send the newsletter through the Mailchimp service (Intuit Inc., USA), which processes the data on our behalf. The transfer to the USA is based on the EU–US Data Privacy Framework and standard contractual clauses. You can unsubscribe at any time using the link at the bottom of every e-mail.

Ads on Facebook and Instagram

We do not send your e-mail address to Meta Platforms Ireland Limited for advertising. We may show you our ads on Facebook and Instagram because you visited our website, if you accepted marketing cookies there (Meta pixel, see the list of cookies), or because you interacted with our page or ads on Facebook or Instagram, for example by filling in the form in one of our ads. For this, Meta uses data it already holds, under its own privacy policy, and we only receive aggregated reports on how our ads perform. You can withdraw your consent to marketing cookies at any time through the “Cookie settings” link in the footer of the page.

How long we keep the data

We keep your address until you unsubscribe. If you do not open any of our e-mails for 24 months, we delete your address.

Black Friday signup 2026

If you sign up for Black Friday updates on our website or in the form in our ad on Facebook or Instagram, we use your e-mail address only to send you updates about Biofarm Black Friday offers until 30 November 2026. The legal basis is your consent. We send these updates through the Mailchimp service, like the newsletter. If you sign up in the form in an ad, Meta Platforms Ireland Limited passes on to us the address you entered. Until 30 November 2026, we may show our Black Week ads on Facebook and Instagram to people who opened or submitted that form. Meta creates this audience on its platform, and we do not send your data for it. We delete your address on 1 December 2026, unless you specifically ticked that you also want to receive the regular newsletter. You can unsubscribe at any time using the link at the bottom of every e-mail.

Data about potential customers

The Company is also authorised to collect data about potential users and/or customers of its services and/or products. This data includes basic data (name and surname, e-mail address) as well as the interests of potential users and/or customers who contact the Company wishing to be informed about and/or offered certain products and services.
The legal basis for collection in this case is the consent of the user and/or customer.

Retention period of personal data

Depending on the purpose and legal basis on which personal data of users and/or customers is collected, the Company is in some cases obliged to keep personal data for the period prescribed by applicable regulations for the particular purpose, or until the purpose for which it was collected ceases. When the statutory retention period expires or the purpose ceases, the data is deleted.
Where the basis for collecting and processing data is the Company’s legitimate interest or the consent of the user and/or customer, personal data is kept for the following periods:
a) data on existing users and/or customers: for the duration of the contractual relationship and 12 months after it ends;
b) data on potential users and/or customers: 3 months;
c) data on newsletter subscribers: as described in the section “Newsletter and ads on social networks”.
Data processed on the basis of the Company’s legitimate interest and/or the consent of users and/or customers may be deleted before the end of the period stated in this Policy if the user and/or customer requests deletion or objects to such processing.

The Company will erase personal data of a user and/or customer in the following cases:
a) when the personal data is no longer necessary for the purpose of processing, or the purpose of processing has ceased;
b) when the user and/or customer withdraws consent as the legal basis for processing and there is no other legal basis for processing;
c) when the user and/or customer objects to the processing (see “Right to object” below);
d) when the personal data has been unlawfully processed;
e) when the personal data must be erased to comply with a legal obligation under EU law or the law of the Member State to which the controller is subject;
f) when the personal data has been collected in relation to the offer of information society services on the basis of a child’s consent.

Right to restriction of processing

The Company will restrict the processing of personal data when the user and/or customer contests the accuracy of the data; when the processing is unlawful and the user and/or customer opposes erasure and requests restriction of use instead; when the controller no longer needs the personal data for processing but the user and/or customer needs it to establish, exercise or defend legal claims; and when the user and/or customer objects to processing based on the Company’s legitimate interest, including profiling of users and/or customers.

Right to object

The user and/or customer has the right to object to the processing of personal data relating to them if the data is processed for the legitimate interests of the controller. In that case, the Company as controller will stop processing the personal data unless it demonstrates compelling legitimate grounds for the processing that override the rights of the user and/or customer, or unless the processing serves to establish, exercise or defend legal claims.
If personal data of the user and/or customer is processed for direct marketing, the user has the right to object at any time to processing for direct marketing, in particular where personal data is used for profiling.

Right to data portability

On request, we will provide the data you gave us on the basis of consent or a contract, which we process by automated means, in a structured, commonly used and machine-readable format, or, where technically feasible, transfer it directly to another controller.

Right to withdraw consent

You can withdraw your consent at any time, as easily as you gave it:
a) newsletter: by clicking the unsubscribe link at the bottom of any of our e-mails;
b) ads on Facebook and Instagram: by switching off marketing cookies through the “Cookie settings” link in the footer of the page;
c) statistics and marketing cookies: through the “Cookie settings” link in the footer of the page;
d) any consent: by writing to info@biofarm.hr or to the data protection officer at hrvoje.begic@biofarm.hr.
Withdrawal does not affect the lawfulness of processing before the withdrawal.

Automated decision-making

We do not make decisions based solely on automated processing, including profiling, that would have legal or similarly significant effects on you.
We respond to requests to exercise these rights without undue delay and at the latest within one month. Exercising your rights is free of charge.

Where personal data is processed

The Company processes personal data of users and/or customers in the Republic of Croatia and, through processors and other recipients, also in other EU Member States and in the USA (for example Mailchimp, Meta and Google). The transfer to the USA is based on the EU–US Data Privacy Framework and standard contractual clauses.

Conditions under which personal data is disclosed to third parties

The Company discloses personal data of users and/or customers to third parties (including competent authorities) only in the following cases:
a) with the consent of the user and/or customer;
b) to comply with the Company’s legal obligations;
c) when such processing is necessary to protect the vital interests of users and/or customers.
In addition, we provide personal data to recipients we need for our business, only to the extent necessary for each task: delivery services (e.g. GLS) for delivery, payment service providers (PayWay, KEKS Pay, PayPal) for payment, Google Ireland Limited and Meta Platforms Ireland Limited for analytics and ads with your consent, and processors who perform certain tasks for us under data processing agreements, such as Mailchimp (Intuit Inc.) for sending the newsletter and providers of web shop hosting and maintenance. We do not sell personal data.

Consent management

The active role of users and/or customers in protecting their privacy is reflected in giving consent as a freely given, specific, informed and unambiguous indication of their wishes, by which they agree, by a statement or a clear affirmative action, to the processing of their personal data. Consent management means that the user and/or customer can authorise the Company, by an active and unambiguous action, to collect and process certain personal data for one or more purposes, and can withdraw previously given consent in the same way.
How to withdraw a particular consent is described under “Right to withdraw consent”.
